History would suggest otherwise...

ICE is going to be begging for the due process they're denying to others.

Hate to break this to you. But let me introduce you to the favorite saying of every Centrist Democrat that gets elected president:

"It is time to heal and move on."

They care more about peace than justice.

[–] [email protected] 3 points 2 weeks ago

that ain't peace, they just want to protect their acomplices.

i'm reminded of something mlk jr wrote, on a related topic:

I have almost reached the regrettable conclusion that the Negro's great stumbling block in his stride toward freedom is not the White Citizen's Counciler or the Ku Klux Klanner, but the white moderate, who is more devoted to "order" than to justice; who prefers a negative peace which is the absence of tension to a positive peace which is the presence of justice;

That's a lot of people - they just want things to be quiet and easy for them, and if there's injustice for others they'll just have to live with it.

see the thing though is that "all of this" in the meme is very vague. it could mean a full-on cultural revolution, one where democrats and republicans alike do not exist anymore. I don't think people are really wanting to go back to the status quo, not really. it's obviously infinitely better than christofascism, but people want meaningful change. probably a big reason why Kamala Harris was not so popular, even though I voted for her

Like they did in 2021? Ha.

[–] [email protected] 10 points 2 weeks ago

That's exactly what they did in 2021. Biden appointed a Republican, Merrick Garland, as his attorney general. And Garland sat on his ass for two years without bringing any charges. Only when they were shamed into it by House committee investigations did they actually start to move. By then, it was too late. Trump ran out the clock. They prosecuted Trump to appease the base, but they did so late enough that Trump stood no chance of conviction before the election.

...Except that qualified immunity exists, and you can't make a law and apply it retroactively.

…Except that qualified immunity exists,

Qualified immunity specifically does not apply in cases where someone's clearly established civil rights were violated, though the criteria for that is specific. Further, it applies only to civil cases, not criminal cases. It may certainly help them in some instances, but it's not going to be a blanket shield.

1 Was a constitutional right violated?

2 Was the right clearly established at the time of the alleged violation?

https://www.justia.com/civil-rights/government-violations-of-civil-rights/qualified-immunity/

Under this doctrine, government agents—including but not limited to police officers—can never be sued for violating someone’s civil rights, unless they violated “clearly established law.” While this is an amorphous, malleable standard, it generally requires civil rights plaintiffs to show not just a clear legal rule, but a prior case with functionally identical facts.

In other words, it is entirely possible—and quite common—for courts to hold that government agents did violate someone’s rights, but that the victim has no legal remedy, simply because that precise sort of misconduct had not occurred in past cases.

While yes, IANAL, I'm exceptionally doubtful that clearly established constitutional rights aren't being violated by the behaviors of ICE under Trump, in many, many circumstances.

[–] [email protected] 4 points 2 weeks ago (1 children)

I’m exceptionally doubtful that clearly established constitutional rights aren’t being violated by the behaviors of ICE under Trump,

Given that what's happening is absolutely unprecedented, I'm pretty sure that there aren't any specific court cases dealing with that kind of shit that's going on right now. Do I WANT all ICE agent to have severe legal consequences for this, if we ever have an election again? Absolutely. But fuck it, I'll settle for some extrajudicial rendition to the Mariana Trench.

The ocean is filthy enough as it is without tossing more trash into it.

Send them to the sun.

[–] [email protected] 4 points 2 weeks ago (1 children)

To the sun is freaking expensive. At the sun is much more efficient and achieves the same end result, if slightly messier.

Parabolas are beautiful, don't @ me.

[–] [email protected] 3 points 2 weeks ago

In this case, it really doesn't matter if you miss so long as it doesn't come back around.

In 1945 in Germany, the murder rate was about 25 times what it is in current day United States.

A lot of people who were "just following orders" got justice.

[–] [email protected] 4 points 2 weeks ago

Oh, sure, and I 100000% support that. (In fact, why wait? Start today!) But that isn't going to be people in camps.

[–] [email protected] 17 points 2 weeks ago (1 children)

Nuremberg trials.... here's to hoping

[–] [email protected] 3 points 2 weeks ago* (last edited 2 weeks ago)

Cofeveberg trials

[–] [email protected] 19 points 2 weeks ago (3 children)

Honestly, I'm surprised that anti-ICE guerrillas still didn't start to appear over the US.

[–] [email protected] 11 points 2 weeks ago

There has been resistance across the board, from restaurant owners to judges.

[–] [email protected] 18 points 2 weeks ago (2 children)

Wouldn't anti ICE be MELT?

[–] [email protected] 2 points 2 weeks ago* (last edited 2 weeks ago)

Proper bunch of melts, yes.

[–] [email protected] 10 points 2 weeks ago (1 children)

Maybe they have and they don't want to advertise their existence

[–] [email protected] 8 points 2 weeks ago (3 children)

If such organization acted even once, it would be instantly on the news all over the world.

[–] [email protected] 2 points 2 weeks ago

Yeah, if you think the manhunt on Luigi Mangione was over the top, wait until someone takes a shot at an ICE agent 'trying to protect the country from illegal immigrants' or however Trump would frame it.

If anyone wanted to try it, they'd need impeccable opsec, because everyone in law enforcement will be looking for them.

[–] [email protected] 3 points 2 weeks ago

Maybe. Suppressing news of activist response is very much alive and well

[–] [email protected] 6 points 2 weeks ago

Don't know if it's an organized group or just a spur-of-the-moment angry mob, but there is this story: https://www.the-independent.com/news/world/americas/us-politics/ice-arrest-mother-video-massachusetts-daughter-b2747948.html
