"On" means a circuit belonging, at time of observation, to the larger number.
"Off" means a circuit belonging, at time of observations, to the nothing number.

I would think "if you have a Y chromosome, you're male" would be a better definition to fit what they're trying to do
Chromosomes are almost never tested at birth, and so 99% of people walking around don’t actually know what chromosomes they have. Enforcing any law based on chromosomes for purposes like this would be nearly impossible.
the thing is that there is no good hard definition of sexes, the best you can do is just go "they fill the general role of male" but guess what! that includes trans people :))
There's like a not insignificant 1% of people who are intersex where looking at chromosomes can get tricky.
Surely there are also people who can produce both/neither reproductive cells. Definitely neither, at least.

Maybe I'm blazed off my rocker, but isn't that an approximate definition you'd get from a biology prof. if they're in a hurry? I swear I heard something like that in one genetics class many moons ago. (I know the actual quote is probably wrong, but the rest is meh ok yeah sure.)
The problem with this definition is that sex differentiation is determined by many genes, and the genetic makeup at conception is not always indicative of what primary and secondary sexual characteristics will develop. This is purely with regards to biological sex, and we're not even talking about a person's gender here.
Embryos can't produce gametes. Everyone is agender now.

I guess the nicest thing I could say about this is that I'm glad that if they're going to be evil, at least they're bad at it.
